TERMS & CONDITIONS

Your Use of This Website and Order Form is Governed by These Terms & Conditions.
These purchase order terms and conditions (“Terms and Conditions”) are hereby incorporated by reference into and made a part of each purchase order issued to OFFO LLC. As used in these Terms & Conditions, "OFFO", "us" or "we" refers to OFFO Corporation and its subsidiaries and affiliates. Please read the following Terms & Conditions carefully as they affect your legal rights.

 

RETURN POLICY:

 

Due to the nature of our business and products we sell, different products may have different policies or requirements associated with them, please see below for products under special categories:


PRODUCTS:

OFFO LLC does not offer Exchanges, Returns or Refunds of any kinds on any Products, all sales are final. 


EQUIPMENT:

We offer a full money-back for Equipment purchases made through OFFO LLC. If you are not satisfied with the equipment that you have purchased from OFFO LLC, you are eligible for a full reimbursement within 14 calendar days of your purchase. The item must be unopened and in its original condition. Customers are responsible for the cost of return shipping. After the 14-day period you will no longer be eligible and will not be able to receive a refund. We are not responsible for the maintenance and repair of the equipment, but we will try our best to help our franchisees to coordinate with the manufacturer.

 

SHIPPING & DELIVERY POLICY:

 

LEAD TIME:

  • Warehouse Pick up: please send us the order at least 1 week in advance. 

  • Delivery: Texas State: please send us the order at least 1 week in advance. (note: Common carrier deliveries typically range from 2 to 3 business days for delivery within Texas Area, exclude delivery times when placing the order.)

  • Delivery: Out of Texas State: please send us the order at least 2 weeks in advance. (note: Common carrier deliveries typically range from 5 to 10 business days for delivery -out of Texas State, exclude delivery times when placing the order)

  • Emergency Pick Up: If a customer needs to pick up an order before a 1 week or 2 week notice, there will be a $50 charge for an early pick up; If an emergency pick up is needed during the weekend, there will be a $100 charge.

(Note: If your delivery time is over a holiday, please add an additional day for delivery. All standard ground delivery times and common carrier shipments are estimates and are not guaranteed.)

 

FREIGHT DELIVERIES:

Due to the weight and volume of the goods, it will ship by a freight company. You can either find your own delivery method or set an account with Freightquote.com. Once you make the order, we will provide information on weight and the number of the pallet to you to get a quote from the freight company.


PAYMENT TO FREIGHT COMPANY:

Payment will be made between you and the freight company. If there’s any payment or billing issues, you will be responsible to contact the freight company directly to dissolve issues.  


SHIPPING INSURANCE PURCHASING:

Customer is responsible for purchasing insurance to cover the shipping, avoiding any potential risks. 


RECEIVING CONDITIONS:

Though our warehouses give great attention to packaging every order for shipment, damage can occur in transit. Please inspect shipments carefully before signing for receival and refuse damaged items. If you are displeased with anything about your shipment, PLEASE CONTACT the freight company immediately. It is your responsibility to inspect the packages carefully before signing for receival, including opening the package to make sure there is no concealed damage. Again, once a customer or their representative signs for a package free and clear we are unable to take responsibility for any damage to the product. 
If any item or packaging is damaged or missing, or if you have any doubt about possible damage, you MUST do the following:

  • Note it clearly on the delivery receipt before signing

  • Keep your copy of the delivery receipt

  • Contact the freight company within 1 business day

  • Keep the damaged packing materials for inspection

  • Take pictures of the damaged items and packaging

Your signature (or that of your representative) indicates that all items identified on the delivery receipt/bill of lading are "RECEIVED IN GOOD CONDITION EXCEPT AS NOTED BY" the person that signs the document. This means that you are relieving the manufacturer, the freight carrier, and OFFO of any liability for the damages. Once you sign the delivery receipt/bill of lading without noting any damage HRS has no method of holding the freight carrier liable for damages.


Don't be unnecessarily rushed. When the products are being delivered, you do need to check the products while the driver is still there. The driver may be insisting that he needs to leave immediately so just sign the form and then file any claims later. Inspect the products and note any potential damage on the delivery receipt/bill of lading.

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something through us, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.
When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

 

 

SECTION 2 – CONSENT

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.
If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.
In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.
Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

 

SECTION 5 - SECURITY
To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

SECTION 6 - AGE OF CONSENT
By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use this site.
